Wild Wing Card – Terms and Conditions:

The following terms and conditions apply to the purchase and use of Wild Wing Gift Cards and constitute an agreement (“Agreement”) between you and Wild Wing Hospitality Inc. (“Wild Wing”, “we”, “us” or “our”).  The actual or attempted purchase or use of a Wild Wing Gift Card constitutes acceptance of this Agreement, as well as our Privacy Policy wildwingrestaurants.com.

The Wild Wing Gift Card comes in two forms: (i) a physical Card; and (ii) an electronically-transmitted eGift Card.  In this Agreement, the terms “Wild Wing Gift Card” or “Card” refer to both the physical version of the Gift Card and the eGift Card, except where indicated otherwise.

Purchasing a Wild Wing Gift Card

The physical Wild Wing Gift Card may be purchased at participating Wild Wing Restaurants in Canada.

Use of Wild Wing Gift Cards

The Wild Wing Gift Card is usable up to its balance for purchases at participating Wild Wing Restaurants in Canada, and on our Online Program.

Participating Restaurants

We cannot guarantee acceptance of your Wild Wing Gift Card at all Wild Wing Restaurants because Wild Wing Restaurants operate as independent franchises.  To find out if a particular Wild Wing Restaurant is a participating restaurant, ask for a manager’s confirmation prior to placing your order or call ahead.

Restrictions

The Wild Wing Gift Card must be presented at the time of purchase.  The Wild Wing Gift Card may not be used to buy additional Wild Wing Gift Cards, and is not redeemable for cash except as required by law and, in such event, only at a participating Wild Wing Restaurant.  The Wild Wing Gift Card may not be resold without the prior consent of Wild Wing.  The Card is not a credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it.

Expiration and Fees

The Wild Wing Gift Card prepaid dollar value balance never expires, nor do we charge any fees in connection with its use.

Registration

You may create a Wild Wing account and register your Wild Wing Gift Card on our Online Program.  In setting up an Wild Wing account, we will request certain information to validate the transaction.  By providing such information, you warrant that all information provided is current and accurate.  To create an account, you must be a legal resident of Canada and over the age of majority in the province or territory in which you reside.  You are responsible for all activities that occur under your account.  You agree to: (a) immediately notify us of any unauthorized use of your password or account or any other breach of security; and (b) ensure that you exit from your account at the end of each session.  We will not be liable for any loss or damage arising from your failure to protect the security of your account. We may communicate with you about your account by email, SMS and/or push notification. Balance

You can check the balance on your Wild Wing Gift Card by inquiring at participating Wild Wing Restaurants, by logging into your account.

Reloading Your Card

You can reload your Wild Wing Gift Card dollar value balance in several ways.  The physical version of the Wild Wing Gift Card may be reloaded at participating Wild Wing Restaurants in Canada, using cash or a credit card. Physical Wild Wing Gift Cards need not be registered in order for them to be reloaded at Wild Wing Restaurants.

Unauthorized Transactions / Replacement of Lost, Stolen or Damaged Cards

You are responsible for all transactions associated with your Wild Wing Gift Card, whether authorized or unauthorized.  You must safeguard your Card.

If you have registered your Wild Wing Gift Card and believe someone has obtained unauthorized access to your account information, you should change your password immediately.  You should ensure that your password is unique to your Wild Wing account and has not been used for any other purpose.  You should also reach out to your financial institution and follow its policies if you believe that charges were made to any credit or debit card on file without your authorization.

We are not responsible for any unauthorized use of your Card.

If you have registered your Wild Wing Gift Card by creating an account, you can deactivate a lost or stolen Wild Wing Gift Card.  We will freeze the unused balance on your Card as of the time of deactivation, and then issue a replacement eGift Card within five (5) business days thereafter. Your Wild Wing Gift Card account balance is yours and may not be transferred or assigned to anyone else or another Card account.

We reserve the right to refuse to accept or otherwise limit the use of any Wild Wing Gift Card if we reasonably believe the use is unauthorized or unlawful.  However, we have no obligation to investigate whether this is in fact the case.

Limitations of Liability and Damages

We make no warranties, express or implied, with respect to your Wild Wing Gift Card, including but not limited to any implied warranty of merchantability or fitness for a particular purpose or any legal warranties of title and quality under the Civil Code of Quebec. In the event that your Card is lost, stolen, damaged, or otherwise rendered non-functional, your sole remedy and recourse, and our sole liability, shall be the replacement of such Card in accordance with the terms set forth above.

We and you agree that, on any claim arising out of or relating to your purchase of, use of, or access to the Wild Wing Gift Card or this Agreement, recovery of damages shall be limited to actual and direct damages, and may not include any indirect or any special, consequential, incidental, enhanced, or punitive damages. We and you both hereby waive the right to seek or recover any indirect, special, consequential, enhanced, incidental or punitive damages.

Changes to Terms and Conditions

These Wild Wing Gift Card terms and conditions are effective upon publication on our Online Program.  You should not use your Card if you object to this Agreement.  Use of the Card constitutes acceptance of this Agreement.

We reserve the right to modify this Agreement at any time, by posting notice of such modifications on our Online Program.

(“Wild Wingʺ, “nousʺ, “nosʺ ou “notreʺ).  L’achat ou l’utilisation réelle ou tentée d’une Carte-Cadeau Wild Wing constitue une acceptation de cet accord, ainsi que notre politique de confidentialité sur wildwingrestaurants.com

La Carte-Cadeau Wild Wing se présente sous deux formes: (i) une carte-cadeau en plastique; et (ii) une carte-cadeau électronique transmise électroniquement. Dans le présent Contrat, les termes “Carte-Cadeau Wild Wingʺ ou “Carteʺ font référence à la fois à la version en plastique de la Carte-Cadeau et à la Carte-Cadeau Électronique, sauf sous indication contraire.

Restaurants participants

Pour créer un compte, vous devez être un résident légal du Canada et avoir atteint l’âge de la majorité dans la province ou le territoire où vous résidez. Vous êtes responsable de toutes les activités qui se produisent sous votre compte. Vous acceptez de: (a) nous informer immédiatement de toute utilisation non autorisée de votre mot de passe ou de votre compte ou de toute autre violation de sécurité; et (b) assurez-vous de quitter votre compte à la fin de chaque session. Vous pouvez remplir le solde de la valeur en dollars de votre Carte-Cadeau Wild Wing de plusieurs manières. La version en plastique de la Carte-Cadeau Wild Wing peut être remplie dans les restaurants Wild Wing participants au Canada, en espèces ou par carte de crédit.  Les Cartes-Cadeaux Wild Wing en plastiques n’ont pas besoin d’être enregistrées pour être rechargées dans les restaurants Wild Wing.

Transactions Non Autorisées / Remplacement de Cartes Perdues, Volées ou Endommagées

Vous êtes responsable de toutes les transactions associées à votre Carte-Cadeau Wild Wing, qu’elles soient autorisées ou non. Vous devez protéger votre Carte.

Si vous avez enregistré votre Carte-Cadeau Wild Wing et pensez que quelqu’un a obtenu un accès non autorisé aux informations de votre compte, vous devez changer votre mot de passe immédiatement. Vous devez vous assurer que votre mot de passe est unique à votre compte Wild Wing et n’a pas été utilisé à d’autres fins. Vous devez également contacter votre institution financière et suivre ses politiques si vous pensez que des frais ont été portés à une carte de crédit ou débit enregistrée sans votre autorisation.

Nous ne sommes pas responsables de toute utilisation non autorisée de votre carte.

Si vous avez enregistré votre Carte-Cadeau Wild Wing en créant un compte, vous pouvez désactiver une Carte-Cadeau Wild Wing perdue ou volée. Nous gèlerons le solde inutilisé de votre Carte au moment de la désactivation, puis émettrons une Carte-Cadeau électronique comme remplacement dans les cinq (5) jours ouvrables suivants. Nous ne sommes pas responsables de toute utilisation non autorisée de votre Carte-Cadeau Wild Wing avant sa désactivation. Le solde de votre compte de Carte-Cadeau Wild Wing vous appartient et ne peut être transféré ou attribué à quiconque ou à un autre compte de carte.

Nous nous réservons le droit de refuser d’accepter ou de limiter autrement l’utilisation de toute Carte-Cadeau Wild Wing si nous pensons raisonnablement que l’utilisation est non autorisée ou illégale. Cependant, nous n’avons aucune obligation de rechercher, si tel est effectivement le cas.

Limitations de Responsabilité et Dommages

Nous n’offrons aucune garantie, expresse ou implicite, en ce qui concerne votre Carte-Cadeau Wild Wing, y compris, mais sans s’y limiter, toute garantie implicite de qualité marchande ou d’adéquation à un usage particulier.  Dans le cas où votre Carte est perdue, volée, endommagée ou rendue non fonctionnelle, votre seul recours, et notre seule responsabilité, sera le remplacement de cette Carte conformément aux conditions énoncées ci-dessus.

Nous et vous convenons que, pour toute réclamation découlant de ou liée à votre achat, utilisation ou accès à la Carte-Cadeau Wild Wing ou au présent Contrat, le recouvrement des dommages sera limité aux dommages réels et directs, et ne peut inclure aucun dommages indirects, spéciaux, consécutifs, accessoires, majorés ou punitifs. Nous et vous renonçons par la présente au droit de demander ou de récupérer des dommages-intérêts indirects, spéciaux, consécutifs, améliorés, accessoires ou punitifs.

Modifications des Conditions Générales

Les présentes conditions générales de la Carte-Cadeau Wild Wing entrent en vigueur dès leur publication à notre Programme en ligne. Vous ne devez pas utiliser votre Carte si vous vous opposez à cet accord. L’utilisation de la Carte constitue votre consentement de cet accord.

Nous nous réservons le droit de modifier cet accord à tout moment, en affichant un avis de ces modifications dans notre Programme en ligne.
